The terms and conditions of each RFP are becoming more and more
complex with the inclusion of Performance Based Statement’s of Work
(PB SOW), Hybrid contract types and an increased emphasis on the
use of Fixed Price Contracts. Each contract type and the various
hybrids being offered have inherent risks to successful contract
performance. These are just some of the areas that make contractual
review of the RFP critical.
Identification and awareness of each risk opens the opportunity
to shape a unique approach to the operation. The development of
questions to clarify ambiguous and conflicting requirements during
the draft review as well as, mitigation strategies for the proposal
content can mean the difference between success and failure financially
and operationally.
When there is a need for someone to provide a contractual assessment
of potential risk areas, develop mitigation ideas and concepts,
identify landmines to be aware of, and offer various strategic approaches
given the specific contract type...
